Pictures and Possibilities - Terms & Conditions
Last Updated: [28th June 2025]These Terms and Conditions ("T&Cs") govern the provision of photo booth hire services by Pictures and Possibilities ("we," "us," or "our") to you, the client ("you" or "the Client"). By booking our services, you agree to be bound by these T&Cs.1. Definitions
"Agreement": Refers to these Terms & Conditions, the booking confirmation, and any agreed-upon add-ons or customisations."Booth": Refers to the photo booth equipment supplied by Pictures and Possibilities."Booking Date": The date of your event as confirmed by us."Client": The individual, company, or organisation making the booking."Service": The provision of the photo booth hire and related services as outlined in the Agreement.2. Booking & Payment
2.1. All bookings are subject to availability.
2.2. A non-refundable deposit of [25% of total booking value] is required at the time of booking to secure your Booking Date. No booking is confirmed until this deposit is received and acknowledged by us.
2.3. The remaining balance of the total booking fee must be paid in full no later than [14 days] prior to the Booking Date.
2.4. Failure to pay the balance by the due date may result in the cancellation of your booking with forfeiture of the deposit.
2.5. Any additional services requested on the Booking Date (if agreed by us) will be charged separately and must be paid in full before provision or upon invoicing, as agreed.3. Cancellations & Amendments
3.1. All cancellations must be made in writing (email accepted).
3.2. Cancellation by the Client:
* If cancelled more than 30 days] prior to the Booking Date, the deposit is forfeited.
* If cancelled between [14 and 30 days] prior to the Booking Date, [Insert Percentage - e.g., 50%] of the total booking fee is payable/forfeited.
* If cancelled less than [14 days] prior to the Booking Date, the full booking fee is payable/forfeited.
3.3. Cancellation by Pictures and Possibilities: In the unlikely event that we are unable to fulfil your booking due to circumstances beyond our control (e.g., equipment failure, severe illness, unforeseen emergency), we will notify you as soon as reasonably possible and offer a full refund of all monies paid. We will not be liable for any further compensation.
3.4. Amendments: Any requests to amend the Booking Date or package details must be made in writing and are subject to availability and our discretion. Additional charges may apply.4. Client Responsibilities & Venue Requirements
4.1. The Client is responsible for ensuring that a suitable, safe, and easily accessible space is available for the Booth at the venue. This includes:
* A flat, solid surface measuring at least [3m x 3m] for the Booth, backdrop, and guest movement.
* Access to a standard 240V mains power supply within [5 metres] of the Booth setup area.
* Adequate shelter if the Booth is to be placed outdoors (protection from rain, wind, direct sunlight). We reserve the right to refuse outdoor setup if conditions are deemed unsafe or potentially damaging to equipment.
* Ensuring clear access for loading and unloading equipment at the venue.
4.2. The Client must inform us of any access restrictions (e.g., stairs, lack of lift, parking limitations) at the venue prior to the Booking Date. Additional charges may apply for difficult access.
4.3. The Client is responsible for obtaining any necessary permits, licenses, or permissions from the venue for the operation of the photo booth.
4.4. The Client is responsible for the conduct of their guests. Any aggressive, abusive, or dangerous behaviour towards our staff or equipment will not be tolerated and may result in immediate cessation of the Service without refund.5. Equipment Use & Damage
5.1. Our professional attendant will operate the Booth and manage guest interaction throughout the hire period.
5.2. Whilst all reasonable care will be taken to ensure the safe use of the Booth and props, the Client shall be responsible for any damage to, or loss of, the Booth equipment, props, or accessories caused by the Client or their guests during the hire period.
5.3. Any damage or loss will be assessed by us, and the Client will be liable for the full cost of repair or replacement. We reserve the right to charge the Client's provided payment method for such costs.
5.4. We reserve the right to cease operation of the Booth at any time if we deem there to be a risk of damage to the equipment or injury to persons. In such cases, no refund will be given.6. Hire Period
6.1. The hire period commences at the agreed start time and concludes at the agreed end time as per the Agreement.
6.2. Any delay in setup due to the Client's or venue's failure to provide adequate access or space will not result in an extension of the hire period.
6.3. If the Booth is required beyond the agreed hire period, and if we are available and agree, additional charges of £75 per hour (or part thereof) will apply, payable immediately.7. Photos & Data Protection (GDPR Compliance)
7.1. Personal Data: We collect and process personal data (such as names, email addresses, and contact numbers) solely for the purpose of fulfilling your booking, providing the Service, communicating with you, and for invoicing.
7.2. Photographs:
* By using the Booth, guests acknowledge and consent to their images being captured.
* All digital photographs taken by the Booth will be provided to the Client as specified in the booking (e.g., via secure online gallery, USB drive).
* Copyright & Promotional Use: In the UK, the person operating the camera generally owns the copyright. However, for a photo booth, guests also have rights. By entering and using the Booth, the Client and their guests grant Pictures and Possibilities a non-exclusive, royalty-free license to use any photographs captured at the event for our legitimate business purposes, including but not limited to: marketing materials, website, social media promotion, and portfolio display. If you or your guests do not wish for photos to be used for promotional purposes, you must inform us in writing prior to the event. We will then take reasonable steps to exclude identifiable images from general public marketing.
* We store digital copies of photos for a period of [6 months] after the event, after which they may be deleted from our systems.
7.3. We are registered with the Information Commissioner's Office (ICO) for data protection compliance.
7.4. We do not share your personal data or photographs with any third parties for marketing purposes.

8.1. We shall not be liable for any failure to perform our obligations where such failure is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, riot, fire, flood, adverse weather conditions, power outages, or strikes.
8.2. Our liability to the Client for any direct loss or damage arising out of the Agreement shall be limited to the total amount paid by the Client for the Service.
8.3. We shall not be liable for any indirect or consequential loss, damage, or expenses (including loss of profit) however arising.9. Governing Law
9.1. This Agreement shall be governed by and construed in accordance with the laws of England and Wales.
9.2. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.10. Severability
10.1. If any provision of these T&Cs is found to be invalid, illegal, or unenforceable by any court of competent jurisdiction, such provision shall be severed from the remainder of these T&Cs, which shall remain in full force and effect.
